PGG Wrightson ‘Bag a Tractor’ Promotion Terms

1. These terms and conditions of entry, including information on how to participate and prize details (Promotion Terms), apply to the ‘Bag a Tractor’ Promotion (Promotion) and entry into the Promotion is deemed acceptance of these Terms.
2. The Promoter is PGG Wrightson Ltd (PGW).
3. The Prize Indemnifier is OddsOn Promotion Ltd.
4. The Prize is a John Deere 5100M iT4 MY18 with 543R Loader. Valued at RLP $110,000.00 (excluding GST). There are three Prizes able to be won.
5. The Qualifying Product for purchase in this promotion is PIONEER® Brand Hybrid Maize Seed in bags of 80,000 kernels (Qualifying Product). Multiples of 7 bags of the qualifying product must be purchased to qualify to enter the promotion. One entry per multiple of 7 bags. No limit to the number of entries subject to clause 14.
6. The Promotion qualifying purchase period commences at 8:00am Monday 17 July 2017 (NZ Time) and closes at 4:59pm Sunday 31 December 2017 (Qualifying Purchase Period).
7. Promotion is exclusive to PGW and is open to both PGW account holders and cash purchasers. For account holders, their account must be paid up to date and meet current terms of trade.
8. Cash purchasers must provide their name and address and phone number when purchasing. PGW Store staff must enter these details into the system with the sale to qualify to enter the promotion.
9. Entry is only open to individuals who are 18 years or over on the date of purchase and who are resident in New Zealand. Employees and immediate families of PGW, Genetic Technologies Limited and Oddson Promotion Ltd and their associated companies are ineligible to enter.
10. To enter and have the chance to win one of the 3 Prizes, you must complete the entry method in clause 10.a during the Qualifying Purchase Period.
    1. a) Visit any PGW store across New Zealand (find your local store here: https://www.pggwrightson.co.nz/locations/retail-store) and purchase 7 bags of the Qualifying Product to qualify to enter the Promotion.
11. At the end of the Qualifying Purchase Period, (Sunday 31 December 2017) PGW will collate all Qualifying Product sales over the Qualifying Purchase Period and calculate how many tickets each qualifying customer receives. PGG Wrightson will then post by mail the game code for each qualifying entry to the qualifying customer.
12. The qualifying customers will have 4 weeks to guess the digits on the tractor plate during the period commencing at 8.00am Monday 15 January 2018 (NZ Time) and closing at 11.59am Monday 12 February 2018 (NZ Time) (Promotional Guess Period).
13. In the letter that is posted to qualifying customers with the game codes it will detail how to guess the plate.
    1. a) This is via a website portal listed on the letter and/or game card.
    2. b) Qualifying customers will be prompted to enter their game code and then requested to fill in their details (including full name and a valid email address), and submit the fully completed entry form online.
    3. c) After following the prompts, qualifying customers will be asked to guess exactly (in the same sequence), the alpha and numerical code which they want to match the number plate code preselected by the Indemnifier.
       1. 2 alpha digits, range A-Z
       2. 3 number digits, range 0-9
       3. The winning entry will correctly guess the 5-digit code that exactly matches the 5 digit code pre-selected by the Indemnifier. This represents the winner identifying the ‘plate code’. There are three different 5-digit codes to be guessed.
       4. Winners will be determined in accordance with the method set out in clauses 13, 15, 16 and 18.
14. There are only 4500 entries available. 4500 chances to guess the code.
15. To successfully win a Prize you must be the first person to accurately guess one of the three tractors’ different number plates (5 digit combination codes with 2 alpha digits and 3 numerical digits) before any other participant.
16. Should more than one exact match code be entered for one or more of the three 5-digit codes, the first matching entry for each code entered on-line closest to the Promotion Guess Period start date will win. If no winning codes are entered, no prizes will be awarded.
17. Incomplete or indecipherable entries will be deemed invalid.
18. The Prize/s will be awarded as follows:
    1. a) The Indemnifier will send PGW the three sealed Master Envelopes enveloped documents containing the winning combinations at the start of the Promotional Guess Period. The winning combinations will also be held by the Indemnifier.
    2. b) At the end of the promotion at 12pm on Monday 12 February 2018 (NZ Time) the Indemnifier shall provide PGW with a copy of the entire database of entries, and the Indemnifier will verify if there is a number plate match.
    3. c) The first three entries with the exact match of the plate code sequences held by PGW will be determined as the three winners.
    4. d) The three winning code combinations will be verified by the Indemnifier.
    5. e) Subject to any directions from a regulatory authority, all qualifying purchases entries will be recorded by PGW and be made available to the public for inspection on request.
19. The Prize/s will be available to the winner/s for collection in the month following the date the Prize is drawn.
20. The winner of the Prize/s will be notified by telephone and email within one week of the end of the Promotion period, and appear on the PGW Facebook Page (https://www.facebook.co.nz) for a period of 28 days.
21. Prizes are not transferable, exchangeable or redeemable for cash. Prizes must be taken as offered and may not be varied. If for any reason a winner does not take a Prize by the time stipulated by PGW, then the Prize will be forfeited.
22. If any Prize is unavailable, then PGW, in its discretion, reserves the right to substitute the Prize with a Prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
23. Independent financial advice should be sought by winners as tax implications may arise as a result of accepting the Prize.
24. Participation in the Promotion will be withdrawn (or forfeited) if Qualifying Products are returned.
25. Decisions of PGW on aspects of the prize draw are final and no correspondence will be entered into.
26. PGW reserves the right to cancel or amend any aspect of the “PGG Wrightson ‘Bag a Tractor’ Promotion” at any time, including Prizes.
27. Registration and ongoing costs of the Prize/s are the responsibility of the winner/s.
28. By entering the Promotion all entrants agree that if they correctly guess the correct code, they will undertake all reasonable steps required by PGW and the Indemnifier to receive the Prize and acknowledge that the Prize will not be available until these requirements have been met to the satisfaction of PGW and the Indemnifier.
29. As a condition of accepting a Prize, each winner must sign any legal documentation as and in the form required by PGW in their absolute discretion, including but not limited to a participation agreement including a legal release and indemnity form.
30. Entrants consent to PGW, Genetic Technologies Limited and John Deere Limited (including its relevant dealers) using their name, likeness and/or image in the event they are the winning entrant (including photograph, film and/or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting the Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by PGW.
31. Nothing in these terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Consumer Guarantees Act 1993 (New Zealand), as well as any other implied warranties or similar consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, PGW (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, PGW (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under PGW’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by PGW) due to any reason beyond the reasonable control of PGW; (d) any tax liability incurred by a winning entrant; or (e) use/taking of a prize.
33. If, for any reason, the Promotion is not capable of being run as planned, including due to infection by infection by computer virus, bugs, tampering, unauthorized intervention, fraud or any other causes beyond the control of PGW, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, PGW reserves the right in its absolute discretion to take any action that may be available to it, subject to national regulations, including cancelling, terminating, modifying or suspending the Promotion or disqualifying any entrant.
34. Any entrant who, in the opinion of PGW, tampers or interferes with the entry mechanism or draw in any way, engages in any unlawful or improper conduct which jeopardizes or is likely to jeopardize the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
35. PGW reserves the right to disqualify entries in the event of non-compliance with these Terms. PGW’s decisions in relation to all aspects of the Promotion are final and binding on each entrant and no correspondence will be entered into.
36. PGW must receive entries during the Qualifying Purchase Period. PGW accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. PGW has no control over mobile telephone or internet communications, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. PGW is not liable for any consequences of user error including (without limitation) costs incurred.
37. PGW collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities. PGW (and its agencies) will also use and handle personal information as set out in its privacy policy, which can be viewed at www.pggwrightson.co.nz. Entry is conditional on providing this information. By entering the Promotion, unless otherwise advised by the eligible entrant, each eligible entrant consents to the information they submit with their entry being entered into a database and being held in a server located in New Zealand. In addition to any use that may be outlined in PGW’s privacy policy, PGW may use this information in any media for future promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the eligible entrant, without any further reference or payment or other compensation to the eligible entrant. All personal details of the eligible entrants will be stored at the office of PGW and held in a server located in New Zealand. A request to access, update, opt out or correct any information should be directed to PGW’s office. Any complaints regarding the treatment of personal information should also be directed to that office and will be dealt with by PGW in accordance with its privacy policy. All entries become the property of PGW. The prizes do not include any charges associated with the connection or use of the prize.
38. By accepting these Terms and Conditions, any participant acknowledges that they will receive a second hand tractor with ownership passing through PGG Wrightson from John Deere. John Deere’s standard warranty for the tractor/loader applies to any prize-winner as if the prize-winner was the original purchaser.
